The judge has found LGBT Ltd in contempt. They have also been found guilty of destroying evidence and trying to move their assets outside the USA. Here’s a portion of the ruling…

1. The Court finds plaintiffs have established, by clear and convincing evidence, that defendants are in contempt of the Court’s order of August 30, 2011. Specifically, plaintiffs have submitted evidence sufficient to show defendants willfully failed to comply with the Court’s directive that they “take any and all steps necessary to effectuate the Receiver’s compliance with [the August 30, 2011 order], including gathering domain name transfer codes for all six relevant domain names and communicating the codes to the Receiver.” (See Order, filed August 30, 2011, at 3:24-26.)

2. As a sanction for the above-referenced contempt:

a. Defendants are fined, jointly and severally, the sum of $1000 per day, payable to the Clerk of the Court, beginning on the date of this order and continuing until such date as they comply with the Court’s order that they transfer to the Receiver the following six domain names: gayforit.com, jerkyourtube.com, itsallgay.com, gayforit.eu,
jerkyourtube.eu, and itsallgay.eu.

b. Defendants shall pay the attorney’s fees and costs reasonably incurred by plaintiffs in filing the instant motion.

3. Key-Systems, USA, Inc. shall, within the next thirty days, transfer the domain names gayforit.com, jerkyourtube.com, gayforit.eu, jerkyourtube.eu, and itsallgay.eu to the
Receiver appointed pursuant to the Court’s order of August 30, 2011.

GLBT Ltd owners Steven and David Compton, who are both UK residents have always claimed that their company was immune from civil liability because the company operates as an Internet service provider under the safe provisions of the Digital Millennium Copyright Act. The company also contended that it can’t be sued in the U.S. because it is an “inconvenient forum” because it operates as an U.K.-based company.

Last month GLBT Ltd fired their attorney Jonathan Capp, who stated that he has been  instructed by defendants to participate no further in this proceeding.

“The court case is still not over…. this is was just about finding them in contempt for refusing to transfer the domain names to a 3rd party receiver. Welcome to the world of legal, ain’t nothing over until its over! We still have to wait and see if we will finally get a final judgement against them and then we can start going after their assets. And even then its unlikely that we’ll get even $0.10 on the dollar for what we’ve spent in legal costs.”, said Keith Webb, President of TitanMen.

Opening up the Pride Season will be the annual Grabby Awards where Chi Chi will once again be the Mistress of Festivities for the weekend. The ePassporte e-Wallet program continues to be up and running, except funds cannot be transferred between your Visa Account and your e-Wallet. At this time ePassporte can no longer issue Visa Cards, and the ability for our Account Holders to make point of sale purchases and withdraw funds from ATMs has also been suspended.

At this time we do not know why this drastic action was taken by Visa. To us, it is unconscionable that such action would be taken without the opportunity for ePassporte to fully understand Visa’s reasons and to be able to take all steps necessary to keep our program running the way it has so successfully done for over 7 years. At this time there is very little information available, but according to several sources that have been in contact with both Visa as well as St. Kitts Nevis Anguilla National Bank, it’s not Visa who suspended the bank’s Visa program, but instead the bank has suspended ePassporte’s account. Hopefully more clear information will follow in the coming days.

In the meantime, most sponsors have sent out messages to inform affiliates about the problems with ePassporte and they urge affiliates to choose alternative payout options as soon as possible.

Today, the case took an interesting twist, as a party that was previously not heard from stepped forward with facts that are potentially damning for defendants David Griffiths a/k/a Tyler Roblan of tylersroom.net, the web hosting company MojoHost, and its CEO, Brad Mitchell.

The Dudevu.com domain name was previously registered to a person by the name of Gail Marion. In court documents filed earlier this year, Griffiths attempted to blame the operation of the site on Gail Marion, and MojoHost and Brad Mitchell both disavowed any knowledge of the inner workings of Dudevu. However, upon learning that the other defendants in the case were essentially using her as a patsy, Marion came forward with an affidavit, sworn under penalty of perjury, that not only did Griffiths run the site, but Brad Mitchell and MojoHost were not mere passive actors in the enterprise.

Marion’s sworn statement contains a number of emails between her and Griffiths in which MojoHost and Mitchell’s involvement seems to be much more active than their court pleadings suggest. “This certainly is important evidence,” said Marc J. Randazza, Corbin Fisher’s general counsel. “There was a while where we were not even sure that Ms. Marion existed. While Griffiths was claiming to us she was the party responsible for DudeVu’s infringing activities, we suspected she was possibly an alias – a made-up name. We are pleased that she came forward, and we eagerly anticipate Brad Mitchell and David Griffith’s statements once they read Ms. Marion’s documents.” In one such e-mail, Griffiths states to Marion he is, “… tired of taking the fall for Brad [Mitchell]…”, who Griffiths then goes on to state was actually in charge of the DudeVu website.

If MojoHost and Mitchell are proven to have been active participants in the Dudevu venture, it would seem to be inconsistent with MojoHosts’s prior public relations campaign in which MojoHost claimed that it would never host a tube site, given their commitment to the adult entertainment industry. However, Marion’s documents suggest that MojoHost and Mitchell had provided Dudevu with free web servers and other support and, if e-mails sent by David Griffiths to Gail Marion are to be believed, that Mitchell himself may have controlled the Dudevu website at the time of the alleged infringements.

This comes on the heels of similar testimony being provided by individuals who spoke to Mitchell at various functions such as the Phoenix Forum. “We have a number of witnesses who have provided sworn statements that contradict what Mr. Mitchell has argued so far,” said Randazza.

Warner Bros. and others claim the unlicensed use of their recordings in pornographic videos “tarnishes” the songs and “diminishes their value.”

“In no uncertain terms, defendants are engaged in copyright infringement of the most blatant and offensive kind,” the complaint states. “Defendants know that major record labels, recording artists, and music publishers do not license their works for use in such pornographic content, especially the type of extreme, sexually explicit videos that defendants produce and distribute. So, defendants simply stole these sound recordings and musical compositions, synchronizing plaintiffs’ works more that 500 times into the soundtrack of their pornographic video without license or consent from plaintiffs, apparently hoping that their conduct would go unnoticed.”

RK Netmedia owns and operates “no fewer than 28″ for-profit websites that sell and distribute pornography, according to the complaint. The complaint includes an 18-page list of violated copyrights, and claims that “defendants not only incorporated plaintiffs’ works into their videos, but then used them to draw an audience to their Web site and to advertise and promote the videos, including by naming the videos after popular songs.”

Besides lead plaintiff Warner Bros. plaintiffs include Elektra, Atlantic, and eight other studios. In addition to disgorgement, punitive damages and an injunction, the studios demand maximum statutory damages of $150,000 per copyright violation.

The RTA label was created to better enable parental filtering and to demonstrate the online adult industry’s commitment to helping parents prevent children from viewing age-inappropriate content.
